The Brazilian Academies of Labor Law (ABDT) and Social Security Law (ABSS) are promoting a virtual meeting via the Sympla platform on June 19, from 9:00 AM to 5:30 PM. The topics for debate are the consequences of the pandemic for labor and social security relations, both today and in the future.
Under the coordination of Marcelo Borsio – Ph.D. in Social Security Law – and Thereza Nahas – professor and Labor Judge –, the event is free and will address, for example, the causal link of Provisional Measure No. 927 of 2020, reduction or suspension of working hours, flexibilization of the employment contract in times of Covid-19, fundamental social rights in times of pandemic, among other topics.
Launched with the objective of reducing the economic impacts on labor relations, Provisional Measure (MP) 927 left loopholes in the understanding regarding the responsibility of companies and employees to prove the causal link for absences due to Covid-19. The infamous article 29 was even the subject of a judgment by the Federal Supreme Court. In the opinion of Hélio Gustavo Alves, PhD professor and member of ABSS, moderation will be required in the practical application of the measure. “The best understanding for applying article 29 of the MP is to guarantee the rights of both workers and companies, that is, judging by the non-incidence of FAP taxation on absences due to Covid-19, since the MP explicitly waived this increase by considering Covid-19 absences as non-occupational,” he evaluates.
