Secretariat of Labor grants 180 days for companies to adapt to the return of the CA

Following the revocation of Provisional Measure No. 905 (MP-905), which established the creation of the Green and Yellow Employment Contract and amended the provisions of Article 167 of the Consolidation of Labor Laws (CLT), the content of which regulates the issuance of the Certificate of Approval (CA) for Personal Protective Equipment (PPE), the Special Secretariat of Social Welfare and Labor published the day before yesterday, on May 6, Ordinance No. 11,347, which establishes the procedures and technical requirements for the evaluation of equipment and the issuance, renewal, or modification of the Certificate of Approval (CA) and grants companies six months to adapt.

The Ordinance establishes that “PPE subject to compulsory evaluation within the scope of the National System of Metrology, Standardization and Industrial Quality – SINMETRO, must be evaluated through the certification modality, by means of domestic Product Certification Bodies – OCP accredited by the National Institute of Metrology, Quality and Technology – INMETRO, in accordance with the Conformity Assessment Regulations – RAC already published by INMETRO, as well as with the provisions of this Ordinance regarding documentary and marking requirements.”

In addition, the document states that “the other PPE must be evaluated through a test report modality, by means of national testing laboratories accredited by INMETRO, in accordance with the criteria established in Annexes I, II, and III of this Ordinance.”

The Ordinance also highlights that test reports older than four years will not be valid for the issuance, renewal, or modification of CA.
