Registration errors and a lack of ongoing management compromise companies' resources and compliance with eSocial

São Paulo, October 2022 Registration errors in sending information to eSocial are still among the main factors that compromise companies' regularization with the program, and can cause them to fall into the audit trap and end up penalized with the respective fines provided for by law. “This is a very common mistake that can result in the company being fined. This happens, for example, when a new employee has one date in their record and a different date in their medical exam. When submitting the documentation to eSocial, the system rejects it because it detects a data conflict,” explained the executive.

Another point of attention raised by Renan is the ongoing lack of attention from many companies regarding Occupational Health and Safety issues. “There are companies that wait to get through the periodic exams required by the standard before deciding what to do. This should be a continuous and permanent process,” he comments.

OH&S management cost savings

According to Soloaga, proper and permanent management, as determined by the NR-1, achieves significant results such as the reduction of absenteeism and the improvement of employees' well-being and quality of life in their respective work environments. This leads to resource savings through the reduction of the Accident Prevention Factor (FAP), fewer leaves of absence, and lower healthcare expenses. Consequently, it avoids the risk of eSocial fines.

The responsibility for OHS management in organizations was another point addressed at the event. “Engineers and/or technicians trained in the field of occupational safety must be responsible for identifying the harmful agents to which workers are exposed, even if the conclusion is that there are no occupational risks. In the work environments where harmful agents are identified, the risk factors will be classified for the preparation and maintenance of the Occupational Risk Management Program (PGR), and this is a legal obligation for companies,” she explains.

According to the CEO of Indexmed, harmful agents, their technical measurements, and classifications also serve as the basis for drafting the Occupational Health Medical Control Program (PCMSO), another legal obligation for companies. The PCMSO establishes the protocols for worker health care at each establishment. Among the program's information, it must define which exams each employee must undergo, and these exams will vary according to the risk exposure identified for that worker through the PGR.

Attention to eSocial

Currently, more than ever, it is important to pay attention to health and safety management in companies. eSocial, the government system that unified the submission of labor obligations for companies and individual employers, is enabling the Ministry of Labor and Social Welfare and the Federal Revenue Service to exercise more effective control over companies' obligations.

“Here is another point that requires attention. The cross-referencing of information will allow supervisory bodies to more easily identify employers that are not fulfilling their obligations in accordance with the law. Consequently, in this new scenario, there is a real possibility of fines and penalties being applied to companies or individuals identified in this condition. Herein lies the challenge of managing so much information and so many obligations without missing deadlines,” warns Renan, who once again drew attention to the eSocial submission deadline of January 1, 2023.

Technology to support businesses

In the end, the executive presented the service offering provided by Indexmed, aimed at simplifying and facilitating processes related to eSocial and enabling preventive management for OSH cost reduction. The Indexmed platform allows companies to meet the minimum legal requirements: Occupational Risk Management Program (PGR), Occupational Health and Safety Medical Control Program (PCMSO), and the Technical Report on the Conditions of the Working Environment (LTCAT). Through it, companies can generate and submit documents, track examinations, manage action plans, among other features to help companies achieve compliance by meeting government-established standards and without missing deadlines.
